Fox News and Bill O'Reilly have been hit with a lawsuit over press statements made in the wake of a New York Times story revealing the former television star had paid $13 million to five women to settle sexual harassment claims.

"Notwithstanding the fact that no current or former Fox News employee ever took advantage of the 21st Century Fox hotline to raise a concern about Bill O'Reilly, even anonymously, we have looked into these matters over the last few months and discussed them with Mr. O'Reilly".

"Knowing Ms. Bernstein and O'Reilly's other victims are afraid to speak out because he and Fox forced them to sign non-disclosure agreements, O'Reilly and Fox have made false and disparaging claims", the statement said.

Rachel Bernstein, who was a junior producer at FOX News, claims she settled a lawsuit in 2002 for an undisclosed amount.

The New York Times first reported on Bernstein's settlement with O'Reilly earlier this year.

Bernstein argued that all this violates the non-disparagement and confidentiality clauses in her settlement.

Bernstein's attorneys said in a statement Monday that she "was not the source for this revelation". She was constrained out of her activity at Fox News and paid a settlement in light of his abuse. She did go to HR and other company executives to complain about him several times. She also says she made repeated complaints in person to the network's human resources department and to other senior Fox News executives.

"He's gone far beyond that and painted our client in a bad light", lawyer Neil Mullin told WaPo, claiming that O'Reilly violated the 2002 settlement case by implying that Bernstein's claims were politically motivated, Variety reported. "Others at Fox confirmed Ms. Bernstein's complaints".

Mullin said O'Reilly's comments violated the 2002 agreement and illustrate a broader issue, in which powerful men who are exposed as harassers attempt to discredit their victims.

The defendants breached their agreement by making statements other than the agreed-upon statement that were false and defamatory, Bernstein alleges. "They should release all victims from their NDS and let the truth out". Mullin's law firm, Smith Mullin, also represented former Fox News host Gretchen Carlson, who alleged she was harassed by the late Fox News Chairman Roger Ailes.
