Third US travel ban largely blocked by federal judge

The third ban came in a September 24 presidential proclamation that Trump issued after acting Homeland Security Secretary Elaine Duke provided him with a classified report recommending the travel restrictions.

Specifically, the third set of travel restrictions banned entry into the US-as immigrants and non-immigrants-all citizens from Chad, Libya, North Korea, Syria and Yemen, citing inadequate sharing of public safety and terrorism-related information, or just general refusal to cooperate, with the United States government.

An attorney from the American Civil Liberties Union, Omar Jadwat, argued that the new version is a "a bigger, tougher version of the same ban" that Trump originally wanted.

The ban is also extended to "certain" Venezuelan government officials and their immediate family members, as the U.S. government has suspended their business and tourist visas.

The decision from Judge Derrick K. Watson in Hawaii is sure to be appealed, but for now, it means that the administration can not restrict the entry of travelers from six of the eight countries that officials said were either unable or unwilling to provide information that the United States wanted to vet their citizens.

The US federal government is likely to appeal Judge Watson's decision.

All those countries except Chad, North Korea and Venezuela were included in two earlier temporary versions of the travel ban, which Trump's opponents called thinly veiled attempts to fulfill his campaign pledge of a "total and complete shutdown of Muslims entering the United States".

The order - which has "no specified end date and no requirement of renewal" - violated a non-discrimination provision in the law in that it blocked immigrants to the US based on their nationality, Chuang wrote.

Trump issued his proclamation only after an "extensive worldwide security review" by federal authorities, she said.

The latest ban, announced last month, was the third version of a policy that targeted Muslim-majority countries but had been restricted by the courts. The government, for example, had undertaken a review process before inking the new measure, and had added two non-Muslim majority countries to the banned list.

Chuang had pressed challengers at a hearing this week on what the government would have to do to make the new ban legal, and he noted in his ruling that the new directive had changed from the previous iterations. Mooppan declined to discuss details of the classified report, and said the government does not have to explain whether Trump's advisers disagreed about the ban.
