Court filing: Marsh seeks OK to sell 26 grocery stores

The company also operates Community Markets, Great Scott Community Markets, Sack 'N Save Supermarket and Chief.

Marsh is selling off the stores after closing 19 locations in May and filing to reorganize under the protection of bankruptcy.

A Marsh Supermarkets spokesman says a court is allowing the sale of 26 of its remaining stores to two Ohio-based grocery chains. One possible obstacle to the sale is an objection by CVS Health, which purchased the pharmacy accounts from Marsh in April.

Neither of the Marsh locations in Kokomo were sold through the auction process as of Tuesday and their fate remains unknown.

During a Wednesday morning hearing in US bankruptcy court in DE, attorneys for the Rhode Island-based pharmacy giant said they no longer objected to the store acquisitions, after the two buyers agreed not to open pharmacies in the stores until at least January 31, 2018.

Topvalco plans to purchase 11 Marsh locations for $16 million, and Generative Growth II has agreed to buy 15 locations for $8 million.

The transactions are subject to bankruptcy court approval.

Fresh Encounters bid $8 million on four locations in OH and 11 others around central Indiana.

A subsidiary of Kroger, Topvalco Inc.is the apparent successful bidder to purchase 11 stores at a cost of $16 million. Marsh has countered that the agreement only bars Marsh from operating pharmacies at the stores, and that the language is not enforceable under the bankruptcy code.
