Trump travel ban dealt another blow as high court weighs in

On Monday, the Ninth Circuit Court of Appeals ruled to largely uphold a Hawaii court's nationwide preliminary injunction that blocked the revised travel ban's 90-day halt on nationals from the six designated Muslim-m.

The 9th US Circuit Court of Appeals in San Francisco was reviewed a March ruling by a Hawaii-based federal judge that blocked parts of Trump's order.

The ruling said the president has violated US immigration law by discriminating against people based on their nationalities and by failing to demonstrate that their entry into the country would hurt American interests. The bench had unanimously ruled against the ban, saying the executive order signed by Trump "exceeded the scope of the authority delegated to him by Congress" to oversee immigration.

"Immigration, even for the president, is not a one-person show", the judges said.

Rather than focusing on Trump campaign statements as the Virginia-based court did, the 9th Circuit said the language in the executive order itself did not make a rational case for why a travel ban was needed.

The majority of those judges found that Trump's executive order "drips with religious intolerance" and that "the reasonable observer would likely conclude that EO-2's primary objective is to exclude persons from the United States on the basis of their religious beliefs".

"That's right, we need a TRAVEL BAN for certain unsafe countries, not some politically correct term that won't help us protect our people!"

A revised executive order announced in March - meant to address the issues raised by the federal judges - deleted Iraq from the list and removed an indefinite ban on Syrian refugees.

Today's ruling says that President Donald Trump overreached his power when he issued the order, and that it is discriminatory. "It does not provide any link between an individual's nationality and their propensity to commit terrorism or their inherent dangerousness".

Trump's initial ban called for blocking entry to all travelers native to seven Muslim nations, and for suspending America's refugee intake.

The White House said Monday that it was reviewing the court's decision.

The Trump administration had previously requested that Supreme Court take up the case following mounting lower court defeats.

Unlike the Fourth Circuit Court of Appeals, which shot down the President's revised travel ban on constitutional grounds last month, the Ninth Circuit was persuaded by statutory claims under the federal Immigration and Nationality Act. The Court should follow its usual practice of awaiting a fully-developed record that is better suited to Supreme Court review.
