NCAA lifts North Carolina ban 'reluctantly' after state repeals so-called bathroom bill

The controversial so-called "bathroom bill" required people to use the public bathroom that matched the gender marker on their birth certificate.

Critics had called the law "anti-LGBT".

North Carolina Senate Leader Phil Berger and House Speaker Tim Moore responded to the NCAA's decision, saying in a joint statement they were pleased with the ruling.

HB2, more colloquially known as the "Bathroom Bill", gained notoriety a year ago for stripping away anti-discrimination protections from the LGBTQ community. Use of such facilities is still the prerogative of the state legislature.

The decision is a particularly upsetting one for Athlete Ally, which worked with the NCAA and National Basketball Association during 2016 amidst H.B. As the Charlotte Observer's editorial board points out, the compromise bill "dodges the whole bathroom question".

"It is disappointing to see the NCAA backpedal after it stood strong against the deeply discriminatory HB2", Human Rights Campaign and Equality NC executive director Chris Sgro said in a statement.

The NCAA Board of Governors announced via a press release early Tuesday that they voted "reluctantly" to lift their ban for the state of North Carolina. "The NCAA championships previously awarded to North Carolina for 2017-18 will remain in the state", the NCAA said in a statement.

"If we find that our expectations of a discrimination-free environment are not met, we will not hesitate to take necessary action at any time", the board of governors clarified in their statement. "Nondiscrimination laws in North Carolina, even under HB2, have always been similar to 29 other states and 10,000 other multiplicities". In total, North Carolina submitted 133 bids for hosting NCAA championship events beginning academic year 2018-19 through academic year 2021-22. Last week, lawmakers replaced it with a compromise that removed the bathroom provision, but still limited the ability of local governments to pass their own LGBT protections.
