Trump Signs Bill Nixing FCC's Broadband Privacy Rules

The bill repeals broadband privacy rules adopted a year ago by the Federal Communications Commission, which required ISPs to obtain subscribers' consent before using their browsing records for advertising or marketing purposes.

President Donald Trump rescinded a rule requiring internet service providers to seek subscribers' permission before using their web browsing history for marketing, handing broadband providers a victory and giving Democrats a campaign issue. Many pro and con opinions have appeared in the last couple weeks as the Senate and the House moved the measure forward via the Congressional Review Act, and that included a statement from the White House indicating the Administration disapproved of the FCC rules.

"We do not sell our broadband customers' individual web browsing history", said Gerard Lewis, the chief general counsel and privacy officer of Comcast, in a statement on the company's website.

Many telecom companies also objected because tech companies like Facebook and Google would not have been affected by the rules.

Internet privacy rules put in place under President Barack Obama are no more. The reason is, most Americans "believe their private information should be just that".

The bill, which has passed both the Senate and House and awaits President Donald Trump's signature, would roll back rules passed by the Federal Communications Commission last October in what Republicans describe as a "midnight regulation". These companies can make money from selling this same information from internet users.

Major providers-including AT&T, Comcast and Verizon-supported the overturning of the internet privacy protections, saying companies like Google and Facebook did not face the same restrictions for how they handle user data. It would also have required ISPs to let users opt out of sharing less-sensitive information (including your name, address, IP address, and subscription level).

President Trump has signed into law Senate Joint Resolution 34 that nullifies the Federal Communications Commission's final rule titled "Protecting the Privacy of Customers of Broadband and Other Telecommunication Services". In the House, 15 Republicans broke rank to vote against the resolution, but it still passed 215-205. "Those flawed privacy rules, which never went into effect, were created to benefit one group of favoured companies, not online consumers". Pai has further stated that now FCC would work with Federal Trade Commission, to restore "FTC's authority to police internet service providers' privacy practices". "The recent action by Congress to suspend FCC rules means that internet providers can save and sell your online activity, including financial and medical health information, to the highest bidder".
